Kansas Foreclosure

The Kansas foreclosure process uses the judicial system to conduct the foreclosure. This is known as a judicial foreclosure process. As in most judicial foreclosure proceedings, the process is started when the lender files a lawsuit with the county where the property is located.

Once the process begins, the judge will give you the borrower some time (usually 30 days or more) to bring the loan current by making up the back payments and costs incurred. If you don't make up the payments, the judge will order that the house be sold at auction at the courthouse steps.

Once this order is given, a notice of the sale must be advertised once a week for 3 consecutive weeks before the sale is to take place. In addition, the last time the ad appears must be between 7 and 14 days before the sale. You, the borrower, must be sent a copy of this notice no more than 5 days after it's first advertised. This process will usually take about 4 months to run its course.
