North Dakota foreclosure
The North Dakota foreclosure process is always judicial. In order to start the process, the lender must file a lawsuit at the courthouse of the county where the property is located.
The court will then decide how much the borrower must pay to cure the default and will give the borrower a bit of time to pay it.
If the borrower doesn't pay in the time allowed, then the court will allow the sale to take place as long as the following procedure is followed:
- At least 90 days before the suit is filed, the borrower must be send a certified notice of the lender's intent to foreclose.
- The notice must state the date and amount of the mortgage, a description of the property, how much is due for each of: principal, interest and taxes and the fact that a lawsuit will be filed if the borrower doesn't pay the necessary amount within the next 30 days.
- The borrower can stop the foreclosure process at any time by paying the amount requested.
- If the borrower doesn't pay in the time allowed then the foreclosure sale will be conducted by the sheriff at the courthouse of the county where the property is located.
The foreclosure process usually takes about 4 months in North Dakota.
