Michigan foreclosure
The Michigan foreclosure process can be judicial but is usually non-judicial. If the judicial foreclosure process is chosen, then the court will determine how much you must pay to make your loan current and keep the house. The judge will give you some time to make the back payments. If you don't make the payments, then the judge will order that the house be sold at auction.
The non-judicial foreclosure process will hinge on whether or not there is a power of sale clause in the mortgage. If there is a power of sale clause and it mentions the time, place and terms of the sale, then those terms are followed.
Now, if there is no power of sale clause or if the time, place and terms of the sale are not in the clause, then the judicial foreclosure process is used and occurs as follows:
- Notice of sale is published once a week in a newspaper of the county where your property is located.
- The notice will be published every week for a period of 4 weeks.
- At least 15 days after the notice is first published, it must also be posted on your property.
- The sale is made at public auction usually conducted between 9:00AM and 4:00PM at the county courthouse.
It'll take at least 2 months to complete this process.
